A Living Will, Health Care Proxy, and Power of Attorney are important legal documents that are customized to memorialize your own personal wishes and interests. The documents are created to protect you, in the event that you become unable to make decisions for yourself. Here's a brief overview of each:

  • Living Will: A living will is a legal document that outlines your wishes regarding medical treatment in the event that you become incapacitated and are unable to communicate your wishes. It typically addresses end-of-life decisions such as whether or not you want to be kept on life support or resuscitated if your heart stops. In New York, a living will is also referred to as a "health care directive."
  • Health Care Proxy: A health care proxy is a legal document that designates someone to make medical decisions on your behalf if you are unable to do so yourself. The person you choose is referred to as your health care agent. Your health care agent may need to make decisions regarding your health and the medical treatments you may receive. The person you choose may also be faced with the responsibility of making difficult decisions including life-sustaining treatments, such as artificial nutrition and hydration, CPR, or mechanical ventilation. The Living Will details your personal preferences, including under what circumstances they are to be considered, in the case you may not be able to do so yourself. Your Health Care Proxy is an aide designed to assist your Health Care Agent to express your wishes. It is very important to choose a health care agent you trust that has similar views to your own. Upon identifying your choice, discuss your wishes with them and provide them with a copy of your living will. 
  •  Power of Attorney: A power of attorney is a legal document that designates a trusted person of your choice to make financial decisions on your behalf upon the unfortunate event you may become incapacitated or are otherwise unable to manage your financial affairs. An attorney-in-fact is the designation of your chosen person shall be is referred as when you need assistance in managing your finances. The Power of Attorney allows the person you chose to pay bills on your behalf, and make other financial decisions for you in the event you are unable to perform these tasks. New York has two types of power of attorney.  A durable power of attorney, which remains in effect even if you become incapacitated and A non-durable power of attorney, terminates if you become incapacitated.
